Client Successfully Dismissed from Significant Product Liability Matter
We obtained dismissal of our client via preliminary objections in a significant product liability matter. The plaintiffs were seriously injured in a workplace accident involving a tile packaging machine. Despite the plaintiffs asserting that original process was properly served on our client, we successfully argued to the court that the purported certified mail receipt was never signed by an agent of our client and, in fact, simply said “COVID-19” on the signature block. The court sustained our objections and dismissed the case as to our client.
Defense Verdict Secured in Section 1983 Malicious Prosecution Trial
We secured a defense verdict in a Section 1983 malicious prosecution trial in the U.S. District Court for the Eastern District of Pennsylvania. The plaintiff alleged that our client’s law enforcement officers falsified evidence and testimony in order to maliciously prosecute him for conspiracy for engaging in the illegal sale of narcotics. We successfully contended that the former narcotics detective, who corroborated the plaintiff’s complaint, was lying, and called various members of our client’s narcotics unit to testify about the facts of the investigation.
Summary Judgment Secured in Fourth Amendment Civil Rights Case
We secured summary judgment in a Fourth Amendment civil rights claim involving an unlawful search and seizure. The plaintiff, a former social worker employed by a school district, alleged that the assistant superintendent and Right to Know Law officer conducted an illegal search of her work space, who then produced these records to the plaintiff’s estranged husband, with whom she was in the midst of a contentious divorce.
Unanimous Defense Verdict in Excessive Force Jury Trial
We achieved a defense jury verdict in a 4th Amendment civil rights trial in the U.S. District Court for the Middle District of Pennsylvania. The plaintiff alleged that two officers of our Northeastern Pennsylvania Police Department client used excessive force to transfer him from the police station’s processing room to a holding cell.
Unanimous Defense Verdict in Medical Malpractice Case
We secured a unanimous defense verdict in a three-week medical malpractice trial involving an allegedly botched total knee replacement. Through the testimony of our client and an expert, we were able to establish that all accepted standards of care were met. The jury deliberated for three days before returning its unanimous verdict.
Summary Judgment Secured in a Racial and Sex-Based Discrimination Employment Case
We obtained summary judgment in an employment litigation case involving claims of racial and sex-based discrimination. The plaintiff alleged that she experienced a hostile work environment based solely on her race. We were able to prove that there was no evidence to substantiate these claims.
Unanimous Defense Verdict in Premises Liability Case
We secured a unanimous defense verdict in a premises liability case where an intoxicated social guest fell down stairs at the defendant’s home. As the plaintiff supplied her own alcohol and was dutifully cared for by the defendants after her intoxication, the jury found for our client.
Two Medical Provider Applications Dismissed with Prejudice
We successfully obtained orders for dismissal with prejudice on two Medical Provider Applications. Two separate New Jersey medical providers alleged they were entitled to additional money for medical treatment provided in New Jersey to a New Jersey resident.
Summary Judgment Obtained in an Auto Negligence Case Involving a Peer-to-Peer Car Sharing App
We secured summary judgment in an auto negligence case, in which we represented a car sharing app and an individual vehicle owner who rented our his car using the app. The plaintiff alleged that, under Florida’s Dangerous Instrumentality Doctrine, the app and the owner were vicariously liable for the renter of the vehicle, who allegedly struck the plaintiff’s vehicle. We successfully argued that the Graves Amendment preempts the application of the dangerous instrumentality doctrine and exempts our clients from vicarious liability for the alleged negligence of the driver.
Summary Judgment Granted in Highly Contested Construction Defect Case
We were granted summary judgment in a $1.3 million construction defect subrogation case involving allegedly improperly sealed roof openings. The subcontractor contested its liability on the theory that our client chose the sealing method, and that the contract itself was deficient. Our motion, that was eventually granted, successfully argued that the contract language met the standard set in Pennsylvania’s Perry-Ruzzi rule.
